Advocacy

Litigation

Representation in civil, criminal, matrimonial, commercial and property proceedings, conducted with careful preparation from the first notice to the final order.

Overview

Litigation rewards preparation. A matter that is properly pleaded, supported by the right documents and argued with a clear sense of what must be proved stands on firmer ground at every hearing. Our work begins with understanding the facts in full, identifying the issues the court will have to decide, and planning how each one will be met.

The firm's litigation practice draws on its areas of practice: civil disputes, criminal defence, matrimonial and family matters, land and property, commercial disputes, intellectual property, tax and money-laundering matters. The firm has chambers at the district courts in Surajpur (Gautam Budh Nagar) and Meerut. No advocate can promise an outcome, and we do not. What we offer is candid advice on merits, risks, cost and time, and diligent attention to the matter at each stage.

Scope of the service

What this includes.

07 elements

  1. 01

    Assessment before proceedings

Reviewing the facts and papers, the period of limitation, the appropriate forum and the relief realistically available, so that the decision to litigate, or not, is an informed one.

  2. 02

    Notices and pre-litigation steps

Legal notices and replies, statutory notices where the law requires them (for instance under Section 80 of the Code of Civil Procedure, 1908, before a suit against the government), and pre-institution mediation in commercial disputes where it applies.

  3. 03

    Pleadings and applications

Plaints, written statements, petitions, replies, rejoinders and interlocutory applications, drafted with close attention to the facts, the documents and the precise relief sought.

  4. 04

    Interim and urgent relief

Applications for temporary injunctions, stay and other interim protection in civil matters, and for anticipatory or regular bail under the Bharatiya Nagarik Suraksha Sanhita, 2023 in criminal matters.

  5. 05

    Criminal proceedings

Representation from the complaint or FIR stage through investigation, charge and trial, for offences under the Bharatiya Nyaya Sanhita, 2023 and special statutes, with procedure governed by the BNSS. This includes matters still governed by the former Indian Penal Code (for offences committed before 1 July 2024) or the Code of Criminal Procedure (for proceedings pending on that date).

  6. 06

    Evidence and trial

Preparing documentary and oral evidence, examination and cross-examination of witnesses, and proof of electronic records in the form the Bharatiya Sakshya Adhiniyam, 2023 requires.

  7. 07

    Appeals, execution and settlement

Appeals and revisions within the time the law allows, execution of decrees and orders, and settlement through Lok Adalat or mediation where that better serves the client.

The process

How a matter proceeds.

  1. 01

    Understanding the matter

We meet, read the papers and build a chronology of events. We want to know not only what happened, but what you need the proceedings to achieve.

  2. 02

    Assessment and terms

We set out the merits, the risks, the likely stages and the time involved, including alternatives to litigation. The scope of work and fees are agreed in writing before we act, and a vakalatnama is executed where we are to appear.

  3. 03

    Preparation and filing

Pleadings and applications are drafted and reviewed with you before filing, with supporting documents organised so that they can be proved when the time comes.

  4. 04

    Hearings and reporting

We attend each listing, report what happened and what comes next, and keep you informed of any decision that requires your instructions.
